Please read these Terms of Service ("Terms") carefully before using the Shepherd macOS application and its associated cloud services (collectively, the "Service").

1. Acceptance of Terms

By downloading, installing, or using Shepherd, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Shepherd is a macOS productivity tool that monitors application windows for user-defined keywords and delivers real-time alerts via Telegram. The Service includes:

• The Shepherd macOS application
• A cloud relay service for alert delivery and remote control
• A web dashboard for viewing alerts and sending commands
• Optional AI-powered event summarization

3. Eligibility

You must be at least 13 years old to use the Service. By using Shepherd, you represent that you meet this age requirement.

4. User Responsibilities

• Lawful Use: You agree to use Shepherd only for lawful purposes. You shall not use the app to monitor windows or content without authorization from the relevant parties.
• Your Configuration: You are responsible for configuring your Watchers, keywords, and alert settings. We are not liable for missed alerts due to misconfiguration.
• Credential Security: You are responsible for keeping your shared secret key and Telegram bot token secure. Do not share these credentials with unauthorized parties.
• Compliance: You are responsible for ensuring your use of Shepherd complies with all applicable local, state, and national laws, including privacy and workplace monitoring laws.

5. Intellectual Property

Shepherd and its original content, features, and functionality are owned by the developer and are protected by applicable copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the application for personal or internal business purposes.

6. Third-Party Services

Shepherd integrates with third-party services including Cloudflare and Telegram. Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free
• Alerts will be delivered instantly or without delay
• AI-generated summaries will be accurate or complete
• The app will detect every occurrence of a monitored keyword

8. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, missed alerts, system downtime, or any decisions made based on AI-generated summaries.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

10. Modifications to Terms

We may revise these Terms at any time by updating this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

11. Termination

You may stop using the Service at any time by uninstalling the Shepherd app and revoking any associated permissions. We reserve the right to terminate or restrict access to the cloud relay service at our discretion if these Terms are violated.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law provisions.
